Central Lancashire Community Infrastructure Levy
Introduction
The following list is in draft form and therefore does not enjoy any formal status. It has been prepared purely for illustrative purposes in association with the consultation and subsequent Examination of the Community Infrastructure Draft Charging Schedules that are being progressed to adoption by the Central Lancashire Authorities of Preston, South Ribble and Chorley. The purpose of the list is to demonstrate the broad range and type of infrastructure that it is likely the authorities will seek to spend CIL funds upon. This is a 'living' document and will be the subject of on-going update and monitoring.
Regulation123 List for 2013/14
CIL Regulation 123 restricts the use of planning obligations for infrastructure that will be funded in whole or in part by the Community Infrastructure Levy, to ensure no duplication between the two types of developer contributions. Regulation 123(2) of the Community Infrastructure Levy Regulation 2010 states, 'A planning obligation may not constitute a reason for granting planning permission for the development to the extent that the obligation provides for the funding or provision of relevant infrastructure'.
A CIL charging authority is expected to publish a list of infrastructure that it intends will benefit from CIL on its website. The Central Lancashire Authorities can review this list at least once a year as part of its monitoring of CIL collection and expenditure. The inclusion of a project or type of infrastructure in this list does not signify a commitment from the Councils to fund either in whole or in part the listed project or type of infrastructure through CIL. Nor does the order of the table imply any order of preference or weighting of one project as opposed to another.
This list has been derived having taken into account the background supporting documents that were prepared in association with the Core Strategy, which set out the infrastructure needed to deliver the development set out in the Strategy up to 2026. T
The Core Strategy was adopted in July 2012.Since that time Lancashire County Council has also adopted LTP3 Strategy and Implementation Plan, which sets out the strategic objectives for transport and travel over the next ten years and the implementation plan sets out a comprehensive programme of transport projects that will be implemented in the three years to 2013/14.
